I am looking for something like this but in addition to the campaign stuff it would be good on first page/site load if can use the pop up box for terms of use of the site and list the conditions. With buttons for accept or reject. Is this possible within the current options? Or something that is possible?

At the bottom of that page is step 2. There you shouldn't specify a submit action, instead put the css class "cc-optin-close" on your "accept" button and perhaps a link to another page on the "decline" button. Also check the "Prevent overlay click" in the Edit content dialog. That should be enough.
